Terms and Conditions
These terms govern access to Mightyfin digital lending, wallet, repayment, verification, and customer services.

1. Acceptance of these Terms
By accessing Mightyfin websites, mobile experiences, loan application forms, customer dashboards, wallet features, or related services, you agree to these Terms and Conditions. If you do not agree, do not create an account, submit an application, or use our services.
You confirm that the information you provide is true, complete, current, and provided by you or with proper authority. You must not submit information for another person without their consent.
2. Legal and regulatory framework
These Terms are intended to operate together with applicable Zambian law, including data protection, consumer protection, financial-services, anti-money laundering, sanctions, tax, electronic communications, and contract-law requirements.
Nothing in these Terms is intended to exclude customer rights, regulatory duties, disclosure obligations, or remedies that cannot lawfully be excluded. Where a mandatory law gives you stronger protection, that law prevails.
3. Services
Mightyfin provides digital loan application, customer onboarding, wallet, repayment, payment-method, identity verification, and customer-support services. Availability of any product is subject to eligibility, affordability checks, product rules, and final approval.
Submitting an application does not guarantee approval, disbursement, a particular interest rate, loan amount, repayment term, or settlement method.
4. Eligibility and customer obligations
You must be legally capable of entering into binding agreements and must provide accurate identity, contact, employment, income, affordability, business, payment, and supporting-document information when requested.
You agree not to misuse the platform, bypass security controls, provide false documents, impersonate another person, interfere with our systems, or use proceeds for illegal purposes.
5. Consent to data collection and verification
Before applying or signing up, you must give clear consent for Mightyfin to collect and process your personal data for account creation, identity verification, affordability assessment, credit-risk assessment, loan processing, wallet services, repayments, fraud prevention, compliance, support, and legally required communications.
We may verify information using internal checks, third-party identity verification providers, payment providers, credit or affordability sources, employers or business contacts you provide, regulatory or compliance databases, and documents you upload.
Your consent may be recorded through checkboxes, timestamps, IP/device metadata, OTP confirmation, PIN confirmation, signed documents, or platform logs so that Mightyfin can evidence lawful collection and customer instruction.
6. Loan terms, repayments, and charges
Approved loans are governed by the final loan agreement, product schedule, repayment schedule, disclosures, and any signed or electronically accepted documents. Those documents prevail over general website content if there is a conflict.
You are responsible for repaying principal, interest, fees, penalties, charges, and collection costs that are lawfully due under your loan agreement. Late or missed payments may affect future access to products and may trigger recovery action where permitted by law.
7. Wallets, payments, and settlement methods
Wallet balances, deposits, withdrawals, transfers, loan repayments, and saved payment methods are subject to verification, transaction limits, provider availability, anti-fraud checks, and successful confirmation from payment processors.
A transaction may be delayed, rejected, reversed, or held for review where required for security, compliance, suspected fraud, insufficient funds, provider failure, incorrect details, or legal obligations.
8. Electronic communications and records
You consent to receive notices, OTPs, statements, loan updates, repayment reminders, verification prompts, and support communications electronically by email, SMS, WhatsApp, phone, in-app notification, or other contact details you provide.
You agree that electronic records, checkboxes, OTP confirmations, PIN confirmations, digital logs, and platform activity records may be used to evidence instructions, consent, applications, and transactions.
9. Security
You are responsible for keeping your PIN, OTPs, device, email, phone number, and account access secure. Notify Mightyfin immediately if you suspect unauthorised access or incorrect transactions.
We may suspend access, require re-verification, or block transactions where we reasonably suspect account compromise, fraud, misuse, or breach of these Terms.
10. Third-party services
Some services depend on third-party providers such as identity verification, payment, communication, hosting, analytics, credit or affordability, and compliance providers. Their systems may have outages or processing delays outside our control.
We are not responsible for losses caused by incorrect details supplied by you, third-party network failures, force majeure events, or unauthorised use resulting from your failure to secure your credentials.
Third-party providers may apply their own lawful controls, security checks, transaction limits, and compliance requirements. Mightyfin may refuse, delay, reverse, or review a transaction or application where a provider or compliance check requires it.
11. Prohibited use and fraud controls
You must not use Mightyfin services for fraud, money laundering, terrorist financing, sanctions evasion, illegal gambling, prohibited goods or services, identity misuse, document forgery, unauthorised access, or any activity that breaches applicable law.
Mightyfin may suspend accounts, hold funds, decline applications, report activity, request more information, or terminate access where required for risk, compliance, legal, or fraud-prevention reasons.
12. Limitation of liability
To the maximum extent permitted by applicable law, Mightyfin is not liable for indirect, consequential, special, punitive, or loss-of-profit damages arising from use of the platform. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
Our liability for a platform error is limited to correcting the error, reprocessing the affected request, or refunding a charge incorrectly applied by Mightyfin, where applicable and lawful.
13. Complaints and disputes
If you have a complaint, contact us using the details below with your name, contact details, issue summary, and supporting evidence. We will review and respond through our support process.
These Terms are governed by the laws of Zambia. Disputes may be handled through internal complaint resolution, competent regulators, mediation, arbitration, or courts with jurisdiction in Zambia, as applicable.
14. Changes to these Terms
We may update these Terms to reflect product, legal, regulatory, operational, or security changes. The latest version posted on this website applies from its effective date.
